TierContest respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond expeditiously to claims of copyright infringement committed using our service.

Copyright Infringement Claims

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on TierContest, please notify our designated DMCA agent as described below.

Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages. Please ensure your claim is valid before submitting.

Filing a DMCA Notice

To file a DMCA takedown notice, please provide our DMCA agent with the following information in writing:

  1. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including the URL or other specific location on TierContest where the material is located.
  3. Your contact information, including your address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature or the signature of a person authorized to act on behalf of the copyright owner.

Counter-Notification Process

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our DMCA agent.

Your counter-notification must include the following information:

  1. Identification of the material that has been removed or disabled and the location where the material appeared before removal or disabling.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located.
  4. A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Your physical or electronic signature.

Response Timeline

DMCA Takedown

We will review and respond to valid DMCA notices within 24-48 hours. Infringing content will be removed or disabled promptly upon verification.

Counter-Notification

If we receive a valid counter-notification, we may restore the content within 10-14 business days unless the original complainant files a court action.

Repeat Infringer Policy

Account Termination: TierContest has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Types of Content Covered

This DMCA policy applies to all user-generated content on TierContest, including:

  • Images uploaded to tierlists
  • Tierlist titles and descriptions
  • Contest names and descriptions
  • User profile content and avatars
  • Any other user-submitted materials

Fair Use Considerations

Before filing a DMCA notice, please consider whether the use of your copyrighted material may qualify as fair use. Fair use is a legal doctrine that permits limited use of copyrighted material without permission for purposes such as:

Misrepresentation Warning

Courts have found that you must consider fair use before sending a takedown notice.

Alternative Dispute Resolution

Before filing a DMCA notice, we encourage copyright owners to contact the user directly to resolve the matter amicably. Many disputes can be resolved through direct communication without the need for formal legal proceedings.

You can contact users through our platform's messaging system or report content through our standard reporting mechanisms for non-DMCA issues.
